POSTING OF WORKERS IN THE FRAMEWORK OF THE PROVISION OF SERVICES. THE ROLE OF THE NATIONAL LABOR INSPECTORATE AS "A COMPETENT BODY" IN THE MEANING OF DIRECTIVE 2014/67/WE AND OTHER PIP TASKS IN THE AREA OF POSTING OF WORKERSThe article seeks to familiarize the reader with the phenomenon of the posting of workers in the framework of the provision of services, with particular emphasis placed on the differences between posting and a business trip. Explaining these differences seems to be of paramount importance in the case of workers posted from the territory of Poland to work abroad as implementation of business trip procedures in a situation of actual posting often leads to the circumventing of legal regulations on social security and personal income tax — deliberately and voluntarily or entirely by accident — and, consequently, to a reduction of the inflow of the amounts due to the state budget. This paper also presents an issue which is inseparably linked with posting, i.e. minimum employment conditions in a host country which must be guaranteed — irrespective of the choice of law made by the parties to the legal relationship — by the employer posting a worker outside the territory of the country where he/she usually performs work.The posting of workers in the framework of the provision of services falls within the area of the labour law regulated by the intracommunity standards which have been implemented in the Polish legal system. The article discusses the main EU legal acts pertaining to this matter and how these regulations have been introduced in the Polish law by means of the Act on of 10 June 2016 on the posting of workers in the framework of the provision of services.When analyzing the contents of the above-mentioned Act, a reference has been made to the National Labour Inspectorate's remit, as per the provisions of the Act, as "a competent body" in the meaning of Directive 2014/67/EU, as well as to other tasks, obligations and rights of this institution resulting from the legal regulations in the area of the posting of workers in the framework of the provision of services.The remarks made in this article, presented in view of the legislation in force, lead to conclusions as regards necessary amendments of legal provisions on the competence and remit of the National Labour Inspectorate as the authority appointed to ensure the rule of law in the area of the posting of workers.
The image of Poland and Poles in Germany emerging from the analysis of public opinion polls and press publications remains ambiguous - it is characterized by complexity and a lack of internal consistency. Positive aspects of the image of Poland and Poles are present to a greater extent in the German press than in the results of public opinion polls. The results of the polls also show a greater inconsistency in the image of Poland and Poles in Germany than press narratives. Two elements of Poland's image are particularly noteworthy in the German press: as an important European actor and as a country with a dynamically developing economy. From the Polish point of view, these two elements should constitute an important "anchor", a kind of starting point organizing the discussion about Poland in the German media. burdened with stereotypes. This is mainly due to the relatively poor knowledge of Germany's eastern neighbor. Poles living in Germany are not of special interest to either the German media or the public. They are also not present in the public discourse themselves. Locally, there was also a lot of interest in the issue of emigration to border areas - especially Mecklenburg-Vorpommern.
Energy transition is surely not only about the technological change, but it also has to necessarily reflect socio-cultural and environmental transformations on the local level. Hence, local communities' energy literacy belongs to the crucial elements in designing successful energy transition and strengthening rural resilience. Energy literacy is a concept widely related to the multifaceted phenomenon of energy consumption, both in its individual and collective dimensions. Therefore, the aim of the present study is to analyse the level of energy literacy in rural conditions, considering its three key dimensions (awareness, attitude, and behaviour). Our reflective considerations about energy literacy build on the current knowledge that stress its importance for the reinforcement of rural resilience. The case study, Zławieś Wielka, in the north-central Poland, was selected where a social survey (N = 300) on the relation between energy literacy and rural resilience was conducted. By means of employing the cross-tabulations method for data analyses, our results signal that certain indications of the ecological awareness among the rural residents are being formed. Our findings clearly suggest that, on the one hand, the needs for more environmentally reasonable management with energy, including electricity and heat, come to the fore. On the other hand, various types of investments in improving the energy efficiency of residential buildings and utilising energy generation from renewable energy sources are observed. It seems that the surveyed community has a clear potential to become the vector for sustainable and just energy transition of the countryside. The essential conditions that urgently need to be implemented to ensure the viability of rural energy transition are the educational reinforcement within the community and more generous long-term institutional support from the central government, targeted on endogenous development and enhancing the local social capital.
